BY USING THIS WEB SITE YOU AGREE ACCEPT, THE TERMS, CONDITIONS AMENDMENTS AND NOTICES PUBLISHED ON THIS WEB SITE (the "Terms").

General Conditions of Use 

  • You must agree to provide current and working email address and telephone number. 
  • You must choose a User ID and password. You are responsible for all actions taken under that User ID and password
  • FISHUP has no control over the quality, safety or legality of the items or services listed. 
  • FISHUP has no control over the truth or accuracy of the listings. 
  • You must not assume that the offer, sale or purchase of any item or service is valid and legal. 
  • FISHUP is not responsible for transactions to be completed. 
  • We reserve the right to store your data on our servers wherever they are. Please do not register if you object to your Information being transferred or used in this way.
  • You must ensure that you are legally able to buy any item or service. 
  • You must not interfere with other user's listing(s). 
  • You are solely responsible for your information we act as a conduit for your online distribution and publication of your information.
  • Communication between all parties – fisheries, accommodation providers, advertisers, anglers and purchasers
  • It is your responsibility to communicate with each other. FISHUP has no responsibility in the event of claims or actions arising between parties, any claim or action must be taken independently of FISHUP (and our officers, directors, and employees). 
  • In the event of a dispute arising using our Site, you agree to pursue any claim or action independently of FISHUP thus releasing us from all claims, liability, damages, losses, costs and expenses, including legal fees,  arising from any claim or action.
  • No action must be taken to damage the integrity of the feedback system. 

Anglers

You have a legal obligation to complete a transaction with a fishery if you have agreed terms by any means of communication.

Only in exceptional circumstances are agreements to purchase retractable, such as when the fishery substantially changes. 

Fisheries

 As a fishery you agree that you are legally able to offer fishing on your water and that your listing is described accurately.

The information on our Site must:

  • Be honest and correct;
  • Not breach copyright, patent, trade mark or right to privacy nor be abusive, defamatory or, obscene;
  • Comply with all relevant laws and regulations;
  • Not be fraudulent; 
  • Not contain computer viruses or similar

Accommodation providers

As an accommodation provider you agree that you are legally able to offer accommodation and that your listing is described accurately.

The information on our Site must:

  • Be honest, correct and have all the necessary permissions required;
  • Comply with all relevant laws and regulations;
  • Not be fraudulent; 
  • Not contain computer viruses or similar

Advertisers

As an advertiser you agree that you are legally able to offer the products or services and that your listing is described accurately.

The information on our Site must:

  • Be honest and correct;
  • Not breach copyright, patent, trade mark or right to privacy nor be abusive, defamatory or, obscene;
  • Comply with all relevant laws and regulations;
  • Not be fraudulent; 
  • Not contain computer viruses or similar

If we suspect that you have engaged or are going to engage in, or have been involved in fraudulent activity in connection with the Site. We may suspend or terminate your registration without notice.

Commission and fees. 

When listing an item or service you will be able to review and accept the fees that you will be charged. 

Unless otherwise stated, all fees are payable in GB Pounds sterling. 

Value added tax and other taxes may apply to your transaction. 

You accept that invoices will be sent in electronic format by email. 

By registering with FISHUP you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, assignable licence to exercise the copyright, trade mark, publicity, database rights and all other intellectual property rights you have in Your Information, in any media. 

You agree that you will not use any robot, spider or other automated means to access the Site for any purpose and you agree that you will not: 

Take any action that imposes an unreasonable or disproportionately large load on our infrastructure; 

With the exception of Your Information, you may not copy, modify or create derivative works from, distribute or publicly display any content from the Site without the permission of FISHUP and the appropriate third party

By accepting this User Agreement, you agree, with respect to other users' personally identifiable information that you obtain through the Site or any FISHUP -communication or FISHUP facilitated transaction, you may only use such information for: 

FISHUP related communications

FISHUP facilitated transaction, 

You must give users an opportunity to remove themselves from your database and to review what information you have about them. Under no circumstances can you disclose personally identifiable information about another user to any third party. 

FISHUP and our users do not tolerate spam or unsolicited commercial communications. 

We (and our officers, directors and employees) do not guarantee continuous, uninterrupted or secure access to our services Operation of the Site may be interfered with by factors outside of our control. 

Nothing in this User Agreement shall limit or exclude our liability for fraudulent misrepresentation, or for death or personal injury resulting from our negligence. Subject to the foregoing, we will not be liable for any economic losses (including, loss of revenues, profits, contracts or business), any loss of goodwill or reputation, or any special, indirect or consequential damages arising out of or in connection with this User Agreement. 

We also have no liability of any sort (including liability for negligence) for the acts or omissions of other providers of telecommunications services or for faults in or failures of their networks and equipment. 

You agree to indemnify, defend and hold harmless FISHUP, its associates or partners, or any company or companies within and its and their officers, directors, employees, affiliated or related entities, agents, subcontractors, suppliers and licensors from and against all losses, expenses, damages and costs, including reasonable legal fees, resulting from any violation by you of these Terms.

Unless otherwise stated, notices to FISHUP must be sent by registered mail to our registered office The Moat, Hughley, Shrewsbury, SY5 6NX and notices to you will be sent to the email address that you provide to FISHUP during the registration process, or by registered mail. 

This User Agreement (and any disputes, claims or proceedings of whatsoever nature arising out of or in any way relating to the use of this Web site and/or the FISHUP Booking Service feature published on this Web site) is governed by and shall be construed in accordance with the laws of England. You hereby consent to the exclusive jurisdiction of the English courts in all disputes arising out of or relating to the use of this Web site. Those who choose to access this Web site from outside the United Kingdom are responsible for compliance with local laws, if, and to the extent that, local laws are applicable. You may not use or export materials or content contained on this Web site in violation of UK and EU export laws and regulations.

If any provision of these Terms shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and FISHUP either as a result of this User Agreement or your use of this Web site.

These Terms are for the benefit of FISHUP, its associates or partners, and Providers, and its and their officers, directors, and employees. Each of these individuals or entities shall have the right to assert and enforce these Terms directly against you on its or their own behalf. A person who is not a party to this User Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this User Agreement.

If any provision of this User Agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall be enforceable. You agree that this User Agreement and all incorporated agreements may be automatically assigned by FISHUP, in our sole discretion, to a third party in the event of a merger or acquisition or any other event. You and FISHUP are independent contractors, and no agency, partnership, joint venture, employee employer or franchisor-franchisee relationship is intended or created by this User Agreement. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. This User Agreement sets forth the entire understanding and agreement between us with respect to its subject matter. No oral explanation or oral information given by any party shall alter the interpretation of this User Agreement.
